Terms of Service

Effective Date: June 1, 2025

Welcome to SkyQuest (the "Service"). The following terms form a legally binding agreement between you and the SkyQuest operating entity ("we" or "us"). By using the Service, you agree to be bound by these terms. If you do not agree, please do not use the Service.

1. Service Description

SkyQuest is an SkyQuest Visibility OS that provides the following core services:

  • AI engine brand citation monitoring and Brand Citation Rate (BCR) scoring
  • AI-driven content generation with RAG-enhanced retrieval optimization
  • Competitive benchmarking analysis and brand tracking
  • Report export and API integration services

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes, we will notify you through reasonable means in advance.

2. Account Registration & Security

To use the Service, you need to register an account. When registering, you agree to:

  • Provide accurate, complete, and up-to-date registration information
  • Keep your account password and access credentials secure, and take responsibility for all activity under your account
  • Notify us immediately if you discover any unauthorized use of your account
  • Not transfer, lend, or sell your account to any third party

3. User Obligations & Conduct

When using the Service, you agree that you will not:

  • Use the Service to distribute or generate any illegal, infringing, defamatory, obscene, or security-compromising content
  • Attempt to bypass or circumvent the Service's technical restrictions or security mechanisms in any way
  • Reverse engineer, decompile, or attempt to obtain the source code of the Service
  • Use automated tools (bots, crawlers, etc.) to call the API at a frequency beyond reasonable limits
  • Use the Service for any purpose that violates applicable laws or regulations

4. Intellectual Property

Intellectual property rights in the SkyQuest platform itself (including but not limited to software code, interface design, trademarks, brand, and documentation) belong to us. Ownership of service-generated content is as follows:

  • Brand materials, configuration data, and corpora you upload through the Service remain your intellectual property
  • You retain the right to use content generated by the Service based on your input (monitoring reports, generated text, etc.)
  • We reserve the right to use aggregated and anonymized data for service improvement, benchmarking, and industry research

5. Disclaimer

The Service is provided "as is." To the maximum extent permitted by law, we make no express or implied warranties, including but not limited to:

  • That the Service will be uninterrupted, error-free, or completely secure
  • That AI engine monitoring results will be fully real-time or completely accurate
  • That content generation results will necessarily improve AI engine citation rates
  • The availability of third-party AI engine services

AI engines are controlled by third parties, and their citation policies, algorithms, and availability may change at any time. We are not responsible for such third-party behavior.

6. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim will not exceed the total fees you paid for the service giving rise to the claim over the preceding 12 months.

7. Subscriptions & Payment

SkyQuest operates on a subscription model, under the following terms:

  • Subscription fees are charged based on your selected plan and billing cycle (monthly/annual); see the purchase page for exact pricing
  • Auto-renewal is enabled by default; you can disable it anytime in your account settings
  • When upgrading, unused portions are prorated as credit; downgrades take effect in the next billing cycle
  • Refund policy: Full refunds available within 7 days of purchase. No refunds after 7 days. Annual plans are prorated based on remaining months

8. Termination

We may suspend or terminate your account under any of the following circumstances:

  • Violation of any provision in these Terms of Service
  • As required by law or regulatory authorities
  • Prolonged inactivity (no login for 12+ consecutive months) without an active subscription
  • Your voluntary request to cancel your account

You may also terminate your use of the Service and cancel your account at any time. After cancellation, we will handle your data according to our Privacy Policy.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of the People's Republic of China. Any dispute arising from or related to these terms shall first be resolved through good-faith negotiation between the parties. If negotiation fails, either party may bring the matter before a people's court with jurisdiction in the location of the SkyQuest operating entity.

10. Changes to Terms

We may update these Terms of Service from time to time. For material changes, we will notify you via email or in-product notification at least 30 days in advance. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
